For the purposes of these Terms and Conditions: • 'Platform' refers to the Sakank website and mobile applications • 'Services' means all features and functionalities provided by Sakank • 'User' means any person who accesses or uses our platform • 'Property Owner' means users who list properties for sale, rent, or exchange • 'Agent' means licensed real estate professionals using our platform • 'Content' means all information, text, images, and materials posted on the platform • 'Listing' means any property advertisement posted on our platform
Acceptance of Terms
By creating an account, browsing listings, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. These terms constitute a legally binding agreement between you and Sakank.
User Eligibility
You must meet the following requirements to use our platform: • Be at least 18 years of age • Have the legal capacity to enter into binding contracts • Provide accurate and complete registration information • Comply with all applicable local, national, and international laws • Not be prohibited from using our services under any applicable laws By using our platform, you represent and warrant that you meet these eligibility requirements.
User Accounts and Registration
Account Creation: • You must create an account to access certain features • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • You are responsible for maintaining the confidentiality of your password • You are responsible for all activities that occur under your account • Notify us immediately of any unauthorized use of your account Account Types: • Individual Client: For personal property searches • Property Owner: For listing properties • Real Estate Broker: For licensed real estate professionals • Developer: For real estate development companies We reserve the right to refuse registration or cancel accounts at our discretion.
Acceptable Use
You agree to use our platform only for lawful purposes. You must not: • Violate any applicable laws or regulations • Infringe upon intellectual property rights • Post false, misleading, or fraudulent information • Engage in any form of harassment or discriminatory behavior • Use automated systems or software to extract data (scraping) • Attempt to gain unauthorized access to our systems • Transmit viruses, malware, or harmful code • Interfere with or disrupt the platform's functionality • Impersonate any person or entity • Use the platform for any commercial purpose without authorization • Post spam or unsolicited advertisements • Collect personal information of other users without consent
Property Listings and Content
Listing Requirements: • All property listings must be accurate, complete, and truthful • You must have legal authority to list the property • Provide genuine photographs and accurate property descriptions • Set fair and realistic pricing • Include all material information about the property condition • Update or remove listings when properties are no longer available Prohibited Content: • False or misleading property information • Duplicate listings for the same property • Properties you are not authorized to list • Discriminatory housing practices or content • Properties involved in illegal activities • Inappropriate or offensive content Content Ownership: • You retain ownership of content you post • By posting content, you grant Sakank a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content • Sakank reserves the right to remove any listing that violates these terms or our policies • We may review, edit, or remove content at our discretion
Property Verification
While we strive to verify listings, we do not guarantee the accuracy of all property information. Users are responsible for: • Conducting their own due diligence before any transaction • Verifying property details independently • Inspecting properties in person when possible • Consulting with legal and real estate professionals • Verifying ownership and legal status of properties Sakank is not responsible for inaccurate, incomplete, or outdated listings.
Fees and Payment
Platform Access: • Basic access to our platform is free for all users • Premium features and enhanced listings require paid subscriptions • Fees are clearly displayed before purchase • All fees are non-refundable unless otherwise stated • We reserve the right to change our fee structure with notice Payment Terms: • Payment must be made through approved payment methods • You are responsible for all applicable taxes • Failed payments may result in service suspension • Subscription renewals are automatic unless cancelled
Communication Between Users
Our platform facilitates communication between property seekers and property owners/agents: • All communications should be professional and respectful • We are not party to any agreements made between users • We may monitor communications to ensure compliance and safety • Users should not share sensitive financial information through the platform • Report any suspicious or inappropriate communication to us immediately
Real Estate Transactions
Important Notice: • Sakank is a listing and communication platform only • We do not participate in property transactions • We do not act as a real estate broker, agent, or representative • All negotiations and transactions occur directly between users • Users should consult legal professionals before completing transactions • We do not verify the financial capacity of buyers or sellers • We are not responsible for the outcome of any real estate transaction
Intellectual Property Rights
Platform Content: • All platform design, code, trademarks, and logos are owned by Sakank • You may not copy, modify, or distribute our proprietary content • The Sakank name and logo are registered trademarks User Content: • You retain ownership of content you submit • You must have rights to all content you post • You may not post content that infringes third-party rights • We respect intellectual property rights and respond to infringement claims
Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our platform, you consent to our data practices as described in the Privacy Policy.
Limitation of Liability
To the fullest extent permitted by law: • Sakank provides the platform 'as is' without warranties of any kind • We do not guarantee uninterrupted or error-free service • We are not liable for any direct, indirect, incidental, or consequential damages • We are not responsible for user-generated content or listings • We are not liable for any losses arising from property transactions • Our total liability shall not exceed the fees you paid in the past 12 months • We are not responsible for third-party websites or services Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Sakank, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from: • Your use of the platform • Your violation of these terms • Your violation of any rights of third parties • Your property listings or content • Any transactions or disputes with other users
Termination
We reserve the right to: • Suspend or terminate your account at any time for violations of these terms • Remove any content that violates our policies • Refuse service to anyone for any reason You may terminate your account at any time by contacting us. Upon termination: • Your access to the platform will cease • Your listings will be removed • Certain provisions of these terms will survive termination
Dispute Resolution
Disputes Between Users: • Sakank is not responsible for disputes between users • Users should attempt to resolve disputes amicably • We may provide contact information but are not mediators Disputes with Sakank: • Any disputes shall be governed by the laws of Yemen • Users agree to first attempt resolution through good faith negotiations • If unresolved, disputes may be submitted to the competent courts of Yemen
Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the platform. Your continued use after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or platform notification. We encourage you to review these terms regularly.
Severability
If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Sakank regarding the use of our platform and supersede all prior agreements and understandings.
